Terms & Conditions
By making booking with Rock and Roll Mountain Biking you agree to abide by the following terms and conditions.
All participants and spectators herein referred to as (“Guests”) must adhere to Rock and Roll Mountain Biking’s Terms and Conditions. These terms and conditions are applicable to all ride locations throughout Western Australia. Rock and Roll Mountain Biking referred to as (“RNR MTB”) and their experiences will be referred as (“the Activity”)
Conditions of Booking
- You must read these terms and conditions prior to making your booking.
- These terms and conditions are to be read in conjunction with our Privacy Policy and Waiver, which together form the whole of your agreement with us.
- We will endeavor to provide you with the activity you booked. However, we reserve the right to amend or alter from time to time any mountain bike activity as we deem to be necessary.
- If in the course of our providing you the activity, the itinerary or experience has to be altered or amended due to circumstances outside our control, e.g. bushfire, typhoon, other inclement weather etc, no refund shall be made to you.
- We will only make changes to the itinerary or Activity booked when necessary and where it is required to do so to ensure the safety of participants.
- In circumstances where minimum numbers are not reached, we may offer you an alternative Activity or refund your booking.
- 7. It is the responsibility of the main organizer, who is booking on behalf of their Guests, to ensure all Guests understand and accept these terms as part of the conditions of entry.
Prices
1. All prices quoted by us are:
a. per person (unless otherwise stated);
b. in Australian dollars; and
c. subject to change at our discretion.
Liability
· We will not be liable for any direct, indirect, consequential or incidental damage, injury, loss, accident, delay or irregularity of any kind, which may be occasioned by reason of any act or omission of any third party (including without limitation, any act, omission or breach of contract of any third party which supplies any goods or services for your experience).
· We are not liable for any injury, death, loss or expense due to sickness, weather, strikes, acts of God, Government action, acts of terrorism, criminal activity, war, quarantine, any other force majeure events or any other cause beyond our control. All losses or expense you may incur from such risks eventuating must be borne by you.
· In the event that any legal action, arbitration, or other proceeding arises with respect to enforcing, interpreting or construing these terms and conditions, or concerning any grievance relating to the booking, the party who prevails shall be entitled to recover its reasonable legal fees and expenses on a solicitor/client basis.
· You will be required to sign a waiver of liability prior to undertaking any tour or experience with us as such tours and experiences involve a higher than the normal risk associated with mainstream holiday tours and experiences.
Cancellation Policy
Our experiences and activities involve extensive organisation and once a booking has been made you will incur cancellations fees as set out in the schedule below.
- 1. RNR MTB operates All weather conditions unless it is deemed dangerous. We will continue rain, hail or shine. However, we will close during electrical thunderstorms and in extreme or catastrophic weather forecasts. This will be at the discretion of RNR MTB.
- 2. Cancellations made 10 or more days in advance of the scheduled booking date, will receive
a full refund or free reschedule, including group booking deposits.
- 3. Cancellations made between 2-10 days from the scheduled booking date will be entitled to a 50% refund or incur a 20% reschedule fee to move the date.
- 4. Cancellations made within 0-2 days of the booking, or no shows will forfeit the entire booking, with no refunds or rescheduling available.
- 5. In the event that RNR MTB cancels prior to the start of your session for any reason, you will be informed immediately. You will be entitled to a full refund or reschedule to a new date.
- 6. In the event you have already started your session and RNR MTB is forced to stop the activity and you are less than halfway through the session, you will be entitled to a free reschedule.
- 7. Forced Majeure Clause: Should events beyond the reasonable control of RNR MTB ,including but not limited to acts of God, war, strikes or labour disputes, airline, flight cancellations, terminated stays, infectious disease such as SARS and COVID-19,government regulation or advisory, disaster, fire, earthquakes, hurricanes, or any other cause reasonably beyond RNR MTB’s control, RNR MTB maintains the right to cancel any booking, providing written notification to the Guest and credit the booking
back to the Guest.
- 8. You will not be refunded for the booking fee or any transaction fees incurred.
- 9. In the event you are unable to attend a tour or experience, you will have the right to transfer the booking to a family member or friend provided you give us written notice of the same including the full name and contact details of the person to whom the booking is to be transferred. They will be required to complete and sign a waiver.
- 10. We are not liable for any incidental losses incurred by you as a result of our cancellation of a tour or experience.
Other Conditions
You consent to our taking photographs, video recordings and/or film footage of you while you are on your tour or experience and that these may be used on our social media pages, and/or advertising or publicity material or other online platforms without obtaining any further consent from you or payment to you in respect of such photographs, video recordings and/or films.
In the event there is a dispute with respect to your booking or experience, the matter will be governed by the law of the State of Western Australia and resolved in the courts of Western Australia.
GIFT VOUCHERS
- Valid for 3 years from the date of purchase (vouchers sold from Jan 2023)
- Are not transferable or redeemable in cash in part or whole.
- RNR MTB reserves the right to refuse a Gift Voucher once it has expired.
- Act as a form of payment and are not a confirmation of a booking. Recipients are required to make an online booking, where they will be prompted to enter their unique Gift Voucher Code during the payment section of the booking process.
- The standard booking cancellation policy will apply after the Gift Voucher has been redeemed. See above ‘Cancellation Policy’ for further details.
- RNR MTB only accepts RBR MTB vouchers or vouchers from
authorised partners.
COVID-19 POLICY:
All Guests must adhere to RNR MTB COVID-19 Policy, which is written in accordance with the State Public Health Orders and subject to change at any given time.
- Where a Government (Federal or State) requires that a person must be fully vaccinated against COVID-19 (or any other disease or virus) or imposes a restriction or requirement of any nature to be able to enter a State where RNR MTB operates in, all Guests must comply with such requirement. RNR MTB will not accept a booking from any Guest that has not complied with or does not commit to such requirement. Where the customer does not meet a vaccination or testing requirement by their appointed session:
- prior to departure from the customer’s home location, the customer will forfeit any and all monies paid; or
- access to the service, the customer will be barred from the premises and will forfeit any and all monies paid.
- Where the customer cancels due to travel restrictions other than vaccination or testing requirements, the customer will be contacted and offered a credit for the booking, where such an offer is at the absolute discretion of the operator. The operator reserves the right to withhold some monies to cover administrative expenses and other losses, dependent on when notice of cancellation is given by the customer.
- Guests are required to scan the QR code for check-in on arrival, and will be asked by RNR MTB personnel for visual confirmation of this via the green tick on the relevant QR app. If QR app check-in is unavailable, Treetops Adventure will require your details to be recorded on the onsite COVID-10 logbook, for the purpose of contact tracing only.
- Guests are required to provide visual evidence of being fully vaccinated or have a medical exemption to be at the premises, where a Government (Federal or State) requires that a person must be fully vaccinated against COVID-19 (or any other disease or virus) or imposes a restriction or requirement of any nature to be able to enter a State where Treetops Adventure operates in Approved documents include but not limited to:
- Australia’s COVID-19 digital certificate. A digital certificate is available for download to smartphone, from the Express Plus Medicare App.
- Immunisation Record from the Express Plus Medicare App.
- Medical Certificate stating Exemption from an authorised practitioner.
- Medical Certificate stating Exemption accompanied by a Statutory Declaration signed by a Justice of Peace (JP).
- Masks are to be carried during your visit to Treetops Adventure. Masks are to be worn when social distancing is not possible, including but not limited to check-in at reception, harnessing, training, around the Home Trees or when waiting on a platform with other Guests who are not part of your booking.
- At this time, spectators must be kept to a minimum. Only spectators and adults supervising children aged 3-17yrs will be able to attend.
- Attending Guests who are suspected of having recently travelled overseas, been unwell or showing symptoms or have been in contact with someone with a suspected or known case of COVID-19, will be required to leave the premises immediately.
- If the park is forced to close in accordance to State Public Health Orders, Treetops Adventure will follow its Forced Majeure Clause (see ‘Cancellation Policy Section 1.g.’), providing Guests with a booking credit. In the circumstances of COVID-19, booking credits will be valid for 12 months. There are no further extensions on booking credits, except in the case of exonerating circumstances or change State Public health orders.
- For changes to bookings requested outside of the specified lockdown periods, the standard cancellation policy will apply.
- If after attending the Activity, a Guest takes a COVID-19 test and returns a positive result, they are required to inform RNT MTB immediately.
